The Health and Disability Commissioner undertook a review of the Code of Health and Disability Services Consumers’ Rights and the Health and Disability Commissioner Act 1994.

The Chief Ombudsman submitted feedback on this review which drew on:

  • his complaint-handling and investigations role in respect of the administrative conduct of public sector agencies
  • his role under the United Nations Convention on the Rights of Persons with Disabilities (Disability Convention) as part of the Independent Monitoring Mechanism (IMM) to protect and monitor disability rights in New Zealand
  • his function as a National Preventative Mechanism (NPM) with the designation for monitoring and examining the conditions and treatment experienced by people in places of detention.
