Te Aka Matua o te Ture | Law Commission is undertaking a review of the laws providing for preventive detention and post-sentence supervision or detention. These laws apply to individuals who are convicted of sexual or violent crimes.
An issues paper was published in May 2023, and a preferred approach paper was published in July 2024. The Chief Ombudsman made submissions on both papers, reflecting his roles under:
- the United Nations Optional Protocol to the Convention against Torture (OPCAT) to monitor places of detention, including persons detained in prisons and otherwise in the custody of the Department of Corrections, and in residences established under section 114 of the Public Safety (Public Protection Orders) Act 2014, and
- the United Nations Convention on the Rights of Persons with Disabilities (the Disability Convention) to protect and monitor rights of disabled people.
