Te Aka Matua o te Ture | Law Commission is reviewing the law relating to adult decision-making capacity. A preliminary issues paper was published in November 2022, and a second issues paper was published in April 2024.

The Chief Ombudsman made submissions on each of these issues papers, reflecting his roles under:

  • the United Nations Convention on the Rights of Persons with Disabilities (the Disability Convention) to protect and monitor rights of disabled people, and
  • the United Nations Optional Protocol to the Convention against Torture (OPCAT) to monitor places of detention, including inpatient mental health services and aged residential care.
