Excerpt: Inspection approach

From late July to September 2023, a team of 15 inspectors, whom I have authorised to carry out visits to places of detention under COTA on my behalf, made an examination of conditions and treatment for detainees at Auckland Prison (the Prison). This included 12 days of unannounced site inspections, on 24 to 28 July, 28 to 31 August, and 4 to 6 September 2023. Since that time, during 2024, my inspectors sought additional information from Corrections after further past incidents of concern came to light regarding use of force at Auckland Prison. Alongside my inspections, that additional information has informed this report.

Inspectors were guided by my expectations for the conditions and treatment of people in the custody of the Department of Corrections. These are that:

  1. The rights of people in custody are upheld by people, principles and practice at all levels.
  2. People in custody are safe and their independence is promoted.
  3. People in custody can build towards their future, through remaining connected with the wider community and access to meaningful development opportunities.
  4. People in custody are treated with dignity and respect.
  5. People in custody enjoy the highest attainable standard of physical and mental health.
  6. People in custody are in an environment that promotes their safety, independence, culture, dignity, and wellbeing.
  7. People in custody are supported by skilled, motivated, and engaged people. 

Inspectors gathered and assessed a range of information, including documents, interviews, and conversations with a number of people, including prisoners and Corrections staff. Inspectors also observed facility activities. Where time allowed, inspectors assessed progress on recommendations I made in my 2020 report. Following each site visit, inspectors met with senior Prison Management to outline their initial observations.
