The Ombudsman is not subject to the Privacy Act 2020 nor the Official Information Act 1982. However the Ombudsman is committed to acting in a manner consistent with these laws when collecting, using and sharing personal information. They apply the spirit of the legislation wherever possible and practical.
Secrecy and privacy
The Ombudsman is required by law to conduct their investigations in private and has to keep information they receive through their work secret unless the Ombudsman specifically decides it must be released as part of their role. This includes personal information. They only share personal information when it is necessary to consider a matter or explain their findings.
