If you are waiting to obtain access to official information from agencies subject to the OIA or LGOIMA, remember that they are required to respond “as soon as reasonably practicable” and “not later than 20 working days” beginning the day after the date on which they receive your request (unless they have properly extended the maximum time limit). However, both Acts say that all the days between (and including) December 25 to January 15 are NOT to be counted as “working days”.
If you don’t get a response by the time the maximum time limit has been reached in your case, the agency will be deemed to have refused your request and you can ask the Ombudsman to investigate and review this. But make sure you are counting the right number of working days first! If you are not sure, you can use our online calculator.
